Minor Guardianships
There are two types of guardianships for minor children. The first type is a Full Guardianship. A full guardianship is established by the filing of a petition with the court where the minor resides or can be found. The petition is filed by the person seeking their appoint as a guardian for the minor setting forth the jurisdictional grounds for the appointment.
The second type of guardianship is called "Limited Guardianship". This type of guardianship is established by the custodial parent of the child completing a petition for the appointment of a guardian for his/her child and consenting to the suspension of his/her parental rights.
In both a full and limited guardianship, the parental rights of the child are suspended, and the restoration of the parental rights will only happen by a finding of the Probate Court that it is in the "best interest" of the child.
